State board revokes license of New Madrid County funeral director
JEFFERSON CITY, Mo. – The State Board of Embalmers and Funeral Directors has revoked the license of James McSpadden, funeral director license number 007271.
This action was taken due to violations of Sections 324.042, 333.101, 333.330, 436.460 and 193.145 RSMo, as McSpadden failed to renew licenses pertaining to his funeral home (Richards Funeral Home) in a timely manner. McSpadden also failed to submit the required annual reports and respond to the requirements of the board’s financial examination for his preneed seller license records.
Additionally, McSpadden failed to provide a headstone (or refund) for two individuals purchased from his funeral home in a timely manner and failed to deposit preneed funds in a financial institution and report such contracts to the board, as required by Missouri law. He charged a fee for a burial gown, which he did not provide, and failed to resolve the matter with the family of the deceased. McSpadden also failed to comply with the board's requirement for annual inspections of his funeral home and failed to file a death certificate for a deceased individual in a timely manner.
McSpadden’s conduct not only violates the terms of his probation but also caused harm to the public and violated the professional trust and confidence of a licensed funeral director.
The revocation of this license means McSpadden can no longer represent himself as a funeral director or perform functions that require a funeral director license.
The State Board of Embalmers and Funeral Directors is the state agency that regulates the funeral profession in Missouri. In addition, the board issues individual and entity licenses within the funeral profession, sets policy regarding professional practice, investigates complaints concerning individuals and entities, and, when appropriate, takes disciplinary action against funeral profession licensees.
